The website tivelune.com is operated by the seller referred to in these Terms as “TIVELUNE.”

Article 2 – Scope

These Terms and Conditions of Sale apply to purchases made on tivelune.com between TIVELUNE and individual consumers.

By placing an order, you acknowledge that you have reviewed and accepted these Terms.

Article 3 – Products

The essential features of our pillows and pillowcases are described on the corresponding product pages.

Product photographs are for illustrative purposes. Minor differences in color or appearance may result from your screen settings or normal manufacturing variations. These differences do not affect the product’s essential features.

You are responsible for choosing a pillow height appropriate for your child’s age and needs. Information provided on this website is not a substitute for medical advice.

Article 4 – Prices

Prices on our U.S. storefront are displayed in U.S. dollars (USD). Any applicable taxes and charges are shown at checkout before you finalize your order.

We offer free standard worldwide shipping to destinations available at checkout.

TIVELUNE may change its prices at any time. However, the price charged will be the price displayed when your order is placed.

Article 5 – Orders

To place an order, select your products and options, review your cart, provide the required shipping information, and choose a payment method.

You can correct any errors before submitting payment.

An order is finalized once payment has been approved and a confirmation email has been sent, subject to product availability and any necessary fraud checks.

TIVELUNE may refuse or cancel an order in cases of suspected fraud, payment issues, an obvious pricing error, or an unresolved dispute relating to a previous order.

Article 6 – Payment

Accepted payment methods are displayed at checkout.

Payment is due immediately. Transactions are processed by secure payment providers. TIVELUNE does not store your complete payment card or bank account details.

Article 7 – Shipping and Delivery

Shipping terms, delivery destinations and estimated delivery times are described on our Shipping & Delivery page.

The risk of loss or damage passes to you when you take physical possession of the product, except where otherwise provided by law.

Article 8 – Returns and Refunds

Our pillows come with a 30-night sleep trial starting on delivery. Returns after use are accepted within the trial under our Returns & Refunds policy. Return shipping is at your expense. Contact us before returning an item.

Nothing in these Terms limits any statutory withdrawal or cancellation right that applies to your purchase. Where a statutory 14-day withdrawal right applies, it remains available in addition to our commercial trial.

Article 9 – Consumer Rights and Warranties

You retain all non-waivable consumer rights and warranties available under applicable law, including applicable California law and federal law of the United States.

If a product is defective or does not conform to your order, contact us at contact@tivelune.com. Any available remedies are determined by applicable law. These protections apply independently of our commercial sleep trial.

Article 10 – Liability

TIVELUNE is responsible for fulfilling its obligations within the limits established by law.

TIVELUNE cannot be held liable for damage resulting from misuse of a product, failure to follow care instructions, product modifications, or use for a purpose other than its intended purpose, to the extent permitted by applicable law.

Nothing in these Terms limits any mandatory consumer rights or excludes liability that cannot lawfully be excluded.

Article 11 – Events Beyond Reasonable Control

Where permitted by applicable law, neither party will be held liable for a delay or failure to perform caused by an event beyond its reasonable control. This does not limit any non-waivable right to cancel an order or receive a refund.

Article 12 – Intellectual Property

The TIVELUNE brand, logo, photographs, illustrations, text, and graphic elements on this website are protected by intellectual property rights.

Unauthorized reproduction, modification, or use is prohibited without prior written permission.

Article 13 – Personal Data

Information about how personal data is processed is provided in our Privacy Policy.

Article 14 – Questions and Complaints

For any question or complaint, please contact TIVELUNE at contact@tivelune.com. You are not required by these Terms to use arbitration or mediation, or to waive any right to seek remedies available under applicable law.

Article 15 – Governing Law

These Terms and purchases made through our U.S. storefront are governed by the laws of the State of California and applicable federal laws of the United States. This choice of law does not deprive you of any non-waivable consumer protections that apply under the laws of your place of residence.

Any dispute that cannot be resolved amicably may be brought before a court having jurisdiction under applicable law. These Terms do not impose an exclusive court venue or waive any non-waivable consumer rights.
